1. Acceptance of Terms
By accessing or using the Cornerstone Callers website (cornerstonecallers.com) or any services provided by Cornerstone Callers, LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use our website or services. By clicking “Submit,” “Send Message,” or any similar acceptance mechanism, you acknowledge that you have read, understood, and agree to these terms, including the binding arbitration and class action waiver provisions below.
2. Description of Services
Cornerstone Callers provides cold calling and lead generation services for real estate wholesalers, agents, and home services companies. Our services include but are not limited to: dedicated cold callers, data sourcing, dialer technology, call recordings, and lead delivery. We are a service provider — we do not guarantee specific results, deal closings, or revenue outcomes.
3. User Responsibilities & Compliance
You are solely responsible for ensuring that your use of leads, data, and communications generated through our services complies with all applicable federal, state, and local laws, including but not limited to the Telephone Consumer Protection Act (TCPA), FCC regulations, state telemarketing laws, and Do-Not-Call registry requirements. Cornerstone Callers does not provide legal advice. You should consult your own legal counsel regarding compliance obligations.
4. Data & Leads
Leads and data delivered through our services are provided on an “as-is” basis. While we strive for accuracy and quality, we do not warrant that every lead will be accurate, complete, or result in a transaction. Lead quality may vary based on market conditions, data freshness, and other factors outside our control. Leads are exclusive to your account unless otherwise stated in your service agreement.
5. Assumption of Risk
You acknowledge and accept all risks associated with contacting individuals based on leads or data provided through our services. This includes, without limitation, potential regulatory actions, consumer complaints, or legal claims. Cornerstone Callers is not responsible for any actions you take based on leads we deliver.
6. Intellectual Property
The Cornerstone Callers name, logo, marks, scripts, training materials, website design, and all associated content are the exclusive property of Cornerstone Callers, LLC. You may not copy, reproduce, distribute, or create derivative works from any of our proprietary materials without express written permission. Call scripts provided as part of our services are licensed for your use during the term of your agreement only.
7. No Agency / No Vicarious Liability
Cornerstone Callers operates as an independent contractor. Nothing in these terms creates an agency, partnership, joint venture, or employment relationship between you and Cornerstone Callers. We are not responsible for any representations made by our callers that deviate from approved scripts or guidelines. You acknowledge that callers act on your behalf when contacting prospects in your market.
8. Indemnification
You agree to indemnify, defend, and hold harmless Cornerstone Callers, LLC, its officers, directors, employees, agents, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of our services; (b) your violation of any law or regulation; (c) your violation of these terms; or (d) any third-party claim related to calls made on your behalf.
9. Limitation of Liability
To the maximum extent permitted by law, Cornerstone Callers, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability for any claim arising out of or relating to these terms or our services shall not exceed the total amount paid by you to Cornerstone Callers in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is less.
10. Suspension & Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use any proprietary materials, scripts, or data provided by Cornerstone Callers ceases immediately. Provisions that by their nature should survive termination (including indemnification, limitation of liability, and arbitration) will survive.
11. Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Oakland County, Michigan. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
12. Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law: (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.
14. SMS Communications
By providing your phone number and opting in, you consent to receive transactional and/or marketing text messages from Cornerstone Callers, LLC. Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP. Reply HELP for assistance. Consent to receive SMS messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.
15. Modifications
We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after any modifications constitutes acceptance of the updated terms. It is your responsibility to review these terms periodically.
16. Entire Agreement
These Terms of Service, together with any applicable service agreement, constitute the entire agreement between you and Cornerstone Callers, LLC regarding the subject matter hereof and supersede all prior or contemporaneous understandings and agreements, whether written or oral.
